DIXON COUNTY BOARD OF SUPERVISORS PROCEEDINGS

 

            The Dixon County Board of Supervisors met on July 13, 2010 at 9:00 A.M. for an adjourned meeting in the jury room in the Dixon County Courthouse in Ponca, Nebraska. Chairman Russell Fleury opened the meeting with the Pledge of Allegiance and called for roll call of members present.  Answering were:  Jerry Schroeder, David Schutte, David Krusemark, Betty Schwarten, Jan Von Minden, Robert Meyer and Russell Fleury.  Absent:  None.  Also present were Diane Mohr, Dixon County Clerk and Secretary to the Board of Supervisors and other interested persons.  Chairman Fleury gave notice to the public of the location of the posted Open Meetings Law.

            Motion was made by Schwarten, seconded by Von Minden to show that this meeting was preceded by due and legal notice by posting as required by law in the Bank of Dixon County, bulletin board in the lower hall of the courthouse, bulletin board in the County Clerk’s Office and two County newspapers, and all Board Members were notified simultaneously and the agenda of all known business to come before the Board of Supervisors was posted the office of the County Clerk.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.

Motion was made by Von Minden, seconded by Krusemark to approve the minutes of the last meeting as written. On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.

Kim Jorgensen with Mercy Business Health Services explained their Employee Assistance Program (EAP) in relation to mental health services.  She will present a formal proposal to the Board, for review and discussion in August.  Also present for this discussion was Dixon County Insurance Committee member, Jane Keitges.

Linda Frahm, Janitor discussed concrete sidewalk and pad, repairs needed for the Courthouse, and electricity for her storage shed.  Steps will be taken to make the needed repairs and updates.

Jackie King-Coughlin, Clerk of Dist. Court discussed the Clerk of the District Court budget.

County Officials, Dean Chase, Jackie King-Coughlin, Diane Mohr and Amy Watchorn were present to discuss salaries in relation to budget preparation.  After discussion, motion was made by Schwarten, seconded by Meyer to allow the current 2% CPI salary increase for full time County Officials, pursuant to the salary resolution, and a $50.00 per month salary increase for employees under the supervision of the County Board.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Meyer and Fleury.  Supervisors against:  Von Minden.  Absent:  None.  Motion carried.

Dean Chase, County Sheriff discussed the jail kitchen remodel and the County’s communications towers.

Amy Watchorn, County Assessor and JoAnn Brennan, Deputy County Treasurer discussed removal and replacement of a wall in the old Treasurer’s and Assessor’s offices.

Authorization was given for the Emergency Manager’s Office to dispose of 2 unneeded cell phones on a motion by Schroeder and second by Meyer.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.

The Board recessed to meet as Board of Equalization, and reconvened with all members present.

The Board toured the jail.

There were no Safety Committee recommendations for the Board.

Purchase of a used dirt scoop for the Allen shop area was discussed and quotes presented.  Motion was made by Krusemark to purchase a 2006 Cat scoop for $105,000.00.  Motion died for lack of a second.  After further discussion, motion was made by Schroeder, seconded by Schutte to purchase a 2000 Cat 5613C used scoop for $77,500.00.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.

Howard Paul with the South Dakota Missouri Sedimentation Action Coalition discussed sediment in the Missouri River and asked the Board to join the Coalition.  No action was taken at this time.

Parttime Road Supt. Brian McDonald was present to discuss ongoing road and bridge projects.

The Federal law requiring a Responsible Charge (RC) person for federal aid road and bridge projects was discussed.  County Clerk employee, Cindy Purucker has been taking online courses to prepare for this position.  The County will not receive funding for federal aid projects until we have someone in that position.

Amendments to the County employee manual regarding road and janitorial worker’s health insurance coverage and comp. time were reviewed and approved on a motion by Krusemark and second by Schwarten.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.

The Sheriff and Treasurer’s Distress Warrant reports were reviewed by the Board.

The Treasurer’s report of uncollectible personal property taxes over two years old was reviewed and motion to strike was made by Schroeder, with a second by Meyer.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.

Correspondence was reviewed.

The County Official’s Fee Reports and Treasurer’s List of Pledged Securities were approved on a motion by Meyer and second by Von Minden.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.

            The Dixon County Board of Equalization met on July 14, 2010 at 9:00 A.M. for a statutory meeting in the Jury Room in the Dixon County Courthouse at Ponca, Nebraska.  Chairman Russell Fleury called for roll call of members present.  Answering were:  Jerry Schroeder, David Schutte, David Krusemark, Betty Schwarten, Jan Von Minden, Robert Meyer and Russell Fleury.  Absent:  None.  Also present were Diane Mohr, Dixon County Clerk and Secretary to the Board and Dixon County Assessor, Amy Watchorn.  Chairman Fleury gave notice to the public of the location of the posted Open Meetings Law.

            Motion was made by Krusemark, seconded by Von Minden to show by the records that this meeting was preceded by due and legal notice by posting as required by law in the Bank of Dixon County, bulletin board in the lower hall of the courthouse, bulletin board in the County Clerk’s Office and two County newspapers, and all Board Members were notified simultaneously and the agenda of all known business to come before the Board of Equalization was posted the office of the County Clerk.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.

            The County Assessor stated her means of arriving at the values were by following the rules and regulations set by the Property Assessment and Taxation Division.  The Nebraska Assessor’s Reference Manual, Nebraska Agricultural Land Valuation Manual, 2010 Reports and Opinions of the Property Tax Administrator and the Dixon County Sales Book were all available during the protest hearings.  The County Assessor presented documentation of assessment practices and procedures, to be made a part of each session of the County Board of Equalization and a part of the record of each protest by reference for these proceedings of the Dixon County Board of Equalization.

            At this time the Board commenced a taped recording of considerations of taxpayer’s written and oral protests, in reference to the 2010 valuation protests, which had been filed on or before June 30, 2010.  Hearings were held on protest numbers one through sixteen.  Consideration was given to the protests and the County Clerk will notify the protestors of the Board’s decision.

            Mary Kellogg representing Eugene C. Adams’ Life Estate was not present for Protest numbers 1 through 7.  The protests said Eugene is in the nursing home, the buildings are deteriorating and the land is rented out on cash rent contract.  The increased profits from the crops go to the renter.  After discussion, motion was made by Schroeder, seconded by Von Minden to follow the Assessor’s recommendation on Protest #1 to lower the valuation of the buildings to $21,475.00.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.  On Protest #2, motion was made by Krusemark, seconded by Schroeder to leave this valuation as it currently is.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.  On Protest #3, motion was made by Meyer, seconded by Von Minden to leave this valuation as it currently is.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.  On Protest #4, motion was made by Schutte, seconded by Meyer to leave this valuation as it currently is.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.  On Protest #5, motion was made by Von Minden, seconded by Schwarten to leave this valuation as it currently is.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.  On Protest #6, motion was made by Meyer, seconded by Von Minden to leave this valuation as it currently is.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.  On Protest #7, motion was made by Krusemark, seconded by Schroeder to leave this valuation as it currently is.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.

Doris Hinz was present to discuss Protest numbers 8 through 11 filed on her and Ray Hinz’s behalf.  She said their land has a large creek running through it, lots of trees and steep hills.  The Assessor determined the number of acres the ASCS Office had listed as CRP ground was more than the Assessor’s  records showed.  On Protest #8, motion was made by Meyer, seconded by Schroeder to increase this valuation to $64,920.00.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.  On Protest #9, motion was made by Von Minden, seconded by Meyer to increase this valuation to $40,095.00.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.  On Protest #10, motion was made by Von Minden, seconded by Schroeder to increase this valuation to $191,140.00.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.  On Protest #11, motion was made by Meyer, seconded by Schutte to increase the valuation of the land to $128,285.00.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.

Mark and Brett Wiedenfield were present to discuss Protest #12 and #13.  They were concerned with the valuation of the pits on their hog confinements.  They stated they are not consistent with surrounding counties.  On Protest #12, motion was made by Schroeder, seconded by Schwarten to lower the valuation of the buildings to $544,815.00.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.  On Protest #13, motion was made by Von Minden, seconded by Schutte to lower the valuation of the buildings to $639,065.00.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.

Sherril and Don Peterson were not present for Protest #14.  Their protest stated the house on this land is a wreck and there are no out buildings or garage.  Motion was made by Meyer, seconded by Schwarten to lower the valuation of the buildings to $35,905.00.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.

Thomas and Lou Ann Kneifl were present for Protest #15 and 16.  They said the fields on this land are cut up by a creek and all the land is not usable.  They believe the valuation of their building should be lower because of their long lane and remote location.  They also read a statement regarding the soil types and land usage not being consistent with the ASCS Office’s records.  On Protest #15, motion was made by Meyer, seconded by Von Minden to leave this valuation as it currently is.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Von Minden, Meyer and Fleury.  Supervisors against:  Krusemark and Schwarten.  Absent:  None.  Motion carried.  On Protest #16, motion was made by Von Minden, seconded by Schroeder to leave this valuation as it currently is.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Schwarten, Von Minden, Meyer and Fleury.  Supervisors against:  Krusemark. Absent:  None.  Motion carried.

            There being no further business to come before the Board of Equalization, motion was made by Von Minden, seconded by Schwarten to adjourn.  On roll call vote, Supervisors voting in favor of said motion were:  Schroeder, Schutte, Krusemark, Schwarten, Von Minden, Meyer and Fleury.  Supervisors voting against:  None.  Absent:  None.
